David Guetta New Years Eve Competition
(“OFFICIAL RULES”)
1. WHO CAN ENTER
The David Guetta New Years Eve Competition (the “Prize Draw”) is open to legal residents of Belgium. Employees or contractors of the Sponsors (as defined below), any person directly or indirectly involved with the Sponsors or the running of the Prize Draw, or such persons’ immediate families and/or members of their same households, are ineligible to enter this Prize Draw. Anyone who attempts to defraud or in any way tamper with the Prize Draw will be ineligible.
2. HOW TO ENTER
Prize Draw begins November 29, 2010 and ends December 12 2010, 00:00 GMT. No entries will be accepted after the above mentioned date and time. To enter, using a computer or other method of Internet access go to the website at http://www.onemorelove.be (”Website”). Click on the game text link or icon either of which will take you to the game home page. Follow the instructions on the game home page, and fill out and submit the Internet Entry Form with your name, email address, age, gender and your response to the competition questions. All entrants must supply full details as required above, and comply with all rules to be eligible for prize(s) (“Entrants”). In the event of a dispute regarding who submitted the on-line entry, the entry will be deemed submitted by the holder of the e-mail account. Any form of entry other than that described herein is void. Only one entry per person is permitted. No responsibility is accepted for ineligible entries or entries made fraudulently. Deeming an entry void is at Sponsor’s absolute discretion. By entering this Prize Draw Entrants will be deemed to have read and accepted these Official Rules and to agree to be bound by them when entering this competition.
3. SELECTION AND NOTIFICATION OF WINNER
Winner will be randomly selected in a drawing on or about December 13, 2010 from all eligible and correct entries received by Sponsors. Odds of winning depend on the number of eligible and correct entries received. Entries become the sole property of Sponsors and will not be returned. Winner will be notified by email. If a potential winner cannot be contacted by email after 5 days from first notification attempt, or a potential winner is found to be ineligible or does not comply with the Official Rules, the prize will be forfeited and an alternate winner may be selected by a second random drawing. By entering this Prize Draw Entrants agree to be bound by these Official Rules and any and all decisions of the judges, which are final and binding in all respects (including not covered by these rules) and no correspondence will be entered into.
4. PRIZE(S)
Trip for one (1) winner (“Winner”) and their guest (of which there will only be one (1) (“Guest”) to have the opportunity to attend a live concert of David Guetta (“Artist”) and have a meet & greet with Artist at the venue after or before the show (to be selected by Artist or Sponsors) (“Prize”).
The Winner and the Guest will be (i) transported to the live concert location by round-trip economy class air transportation on an airline selected at Sponsor’s sole discretion from a major gateway airport closest to the Winner’s residence (in principle Brussels International Airport (Zaventem)) – please note that flights may not be direct – and (ii) provided standard hotel accommodation for minimum two (2) days and one (1) night (standard twin/double with breakfast). (“Trip”) Approximate Retail Value – EUR 2.000 per person, subject to location of Winner and fares in effect at the time of departure.
The Winner and the Guest must travel together. If the Winner is a minor, he/she needs to be accompanied by an adult. The Winner and the Guest is each responsible for obtaining, possessing and paying for any valid passports, insurance and/or visas required for their travel. The Winner and the Guest will not be permitted to travel unless they are in possession of the relevant travel documents at the time of departure. Each of the Winner and the Guest is responsible for any and all ground transportation and any and all other incidentals and expenses including, but not limited to, meals, gratuities and phone calls and any airport transfers.
Trip subject to air travel/hotel availability, holiday/blackout dates and all other prize and travel restrictions. Once Trip dates, times and/or any other arrangements have been determined, no change or substitution of those Trip dates, times or other arrangements are permitted except at Sponsors’ sole discretion. Sponsor is not responsible for cancellation of the Trip (whether all or part of the Trip) or change of performance (whether the Artist’s performance of otherwise).
5. PRIZE LIMITATIONS
All expenses not specifically included in the Prize as described in these Official Rules are hereby excluded. the Prize must be taken as stated and cannot be deferred. Winner may not substitute another Prize or receive a cash equivalent. Once Prizes have been allocated and dispatched then cannot be transferred. Sponsors, at their sole discretion, may substitute a Prize or cash of equal or greater value at any time and for any reason. Any depiction of Prizes is for illustrative purposes only. Contest is subject to these Official Rules and all applicable laws. Winner is solely responsible for any and all taxes on Prizes. Sponsors are not responsible for delay in Prize delivery.
6. WINNER RELEASE FORMS
Winner and Guest must execute, notarize and return within five (5) days of receipt by Winner any documentation that Sponsor may require. Except where prohibited by law, the Winner’s the Guest’s acceptance of the Prize is permission for Sponsors to use the Winner’s and Guest’s name, photo, likeness, biographical information, statements, voice, and address (city and state only) for advertising/publicity purposes related to the Prize Draw worldwide and in all media and in perpetuity without further compensation.
7. LIMITATION OF LIABILITY
By entering the Prize Draw, each Entrant releases the Sponsor, their advertising and promotion agencies, and any agents involved in the development, production or handling (including Prize suppliers), implementation and distribution of this Prize Draw, and their respective parent companies, affiliates, subsidiaries, service providers, officers, employees and any other person/entity associated with the Prize Draw (collectively, the “Prize Draw Entities”) from any and all liability for losses/ expenses of any kind (including, without limitation, property damage,) resulting from participation in the Prize Draw including acceptance and/or use/misuse of Prize, or any typographical or other error in the printing, offering or announcement of any Prize. By entering the Prize Draw, Entrant also grants Sponsor the right to use entry information for marketing purposes to the extent permitted by law, and releases Sponsors from any claims or liability relating to such use. Entrants agree that none of the Prize Draw Entities has made or is responsible for any representation or guarantee, express or implied, in fact or in law, relative to the prizes. Proof of entry is not proof of receipt.
If for any reason the Prize Draw cannot run as planned, Sponsor reservess the right to cancel/modify/suspend the Prize Draw and conduct the Prize Draw from all salvageable entries received, if any.
Prize Draw Entities are not responsible/liable for multiple entries entered by other than human means or other mechanical means, or for entries that are late (including delayed data transmissions), illegible, mutilated, forged, tampered with, destroyed, incomplete, lost, misdirected, mechanically duplicated, mass machine printed, or postage-due, or entries otherwise not in compliance with Official Rules (and all such entries will be disqualified).
Prize Draw Entities are not responsible or liable for (whether on or not related to any inability to submit entries) any malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, server failure, error, interruption, defect or delay or any other technical malfunctions or any combination thereof, or any damage to an Entrant’s or third person’s computer and/or its contents.
8. JURISDICTION
This Prize Draw and the rules of the Prize Draw are governed by the laws of Belgium and the exclusive jurisdiction of the courts of Brussels.
